Limited Warranty and Disclaimer, Limitation of Remedies and Damages for all CIMware products published in any format, including printed material on paper, or electronically readable formats, including data and software on magnetic diskettes, CD-ROMs, Digital Variety Disks (DVDs) and any other formats, including the Internet.
You acknowledge that the data and/or software may not satisfy all your requirements or be free from defects. CIMware Ltd. UK and CIMware USA, Inc. (referred to as CIMware) warrants the diskettes, or CD-ROMs, or DVDs, on which the data and software is recorded to be free from defects in materials and workmanship under what is considered to be normal use in IT terms for 90 days from the date of purchase, but the data and software and accompanying written materials are licensed on an "as is" basis.
All implied warranties and conditions (including any implied warranty of merchantibility or fitness for a particular purpose) are disclaimed as to the data and software and accompanying written material(s) and limited to 90 days as to the diskettes, or CD-ROMs or DVDs, or other electronically readable media sold with the product.
Your exclusive remedy for breach of warranty will be the replacement of the diskettes, or CD-ROMs or DVDs, or other electronically readable media sold with the product or refund of the purchase price. In no event will CIMware or its developers, directors, officers, consultants or other affiliates be liable to you for any consequential, incidental or indirect damages (including damages for loss of business profits, business interruption, loss of business information, and the like), whether foreseeable or enforceable, arising out of the use of or inability to use the data, or software or accompanying written materials, regardless of the basis of the claim and even if CIMware or an authorised CIMware representative has been advised of the possibility of such damages.
To use any of the data, or software, including drawings, and/or images, and/or models, and/or any objects on the data disks, or software, or CD-ROMs, or DVDs, or any other media used in the product you must have a valid CIMware license covering the CIMware product, meaning, that you have purchased a legal CIMware product. Use of the data and/or software is governed by that CIMware product license, as well as the following:
You may copy the individual images, pictures, models and drawings form the CIMware data disks by dragging and pasting them the usual way into your own documents, in the same or in a modified format, including documents created by non- CIMware products. You may not, however, distribute the CIMware data disks, software, or CD-ROMs, or DVDs, or any other media used in the product in whole or in part, modified or unmodified, electronically or on paper, or by any other means for use by others commercially or otherwise without CIMware's written permission. What does "Royalty Free" mean for all Digital Art & Video Clip Library materials and products: The images are provided to the recipient "as is". All implied warranties are hereby disclaimed, including without limitation, the warranties of title, infringement, merchantibility, and fitness for purpose for any particular purpose, to the extent, that if the images, or video clips, or 3DVR clips, or 360 degree panoramas and other objects include any trade name, or trademark, or service mark owned by a third party, or likelness of a reference to an individual, the user is responsible for obtaining appropriate permissions and licenses from such third party or individual for his/her purposes. Since the purpose of this Library is to enable professional art and graphic designers, multimedia developers, academics and students and others to create art and media products and to be compensated financially for their work, we follow the "industry standard" approach to this problem, in that we offer three types of licenses, these being the Comping License, the Basic License and the Resale License.

UK&USA products electronically or otherwise onto a server and distribute it electronically without CIMware Ltd.'s written permission to do so!
